Terms of Use

  1. These terms apply to your use of this website (www.carclaimschecker.co.uk).
  2. SJK Legal Limited is a firm of solicitors authorised and regulated by the Law Society of Scotland (company no. SC682934) and its registered office is 4-10 Darnley Street, 1st Floor, Glasgow, G41 2SE. Car Claims Checker is a trading name of SJK Legal Limited (‘Car Claims Checker’).
  3. Harcus Parker Limited is a firm of solicitors authorised and regulated by the Solicitors Regulation Authority (SRA no. 653501), registered in England & Wales (company no. 11352441), and its registered office 80 Strand, London, WC2R 0DT. Parker Kerrigan is a trading name of Harcus Parker Limited (‘Parker Kerrigan’).
  4. A Claim in respect of these terms means: making a complaint to your motor finance lender(s) regarding the use of discretionary commission arrangements; b) the payment of high commissions, defined as commissions which are equal to or greater than 39% of the total charge for credit and 10% of the credit amount; and/or c) contractual ties that gave the lender exclusivity or a right of first refusal (‘Claim’).
  5. Car Claims Checker acts as an introducer. This means that, including but not limited to, you are contacted by Car Claims Checker, engage with them through advertising, and/or fill out the form on their website, and you wish to proceed with a Claim, it will introduce your details to its partner law firm, Parker Kerrigan.
  6. Car Claims Checker will not process, run, or handle your Claim. You will not be charged a fee for being introduced by Car Claims Checker to Parker Kerrigan. Car Claims Checker, however, may receive a fee for your introduction to Parker Kerrigan.
  7. Should you choose to instruct Parker Kerrigan, your contractual agreement will be with them. Their terms and conditions, as set out in their Document Pack will apply (‘Agreement’). That Agreement will have your signature affixed to it once you electronically sign it. It is important you read that Agreement before signing. Upon accepting that Agreement, Parker Kerrigan will undertake a soft credit check and run your Claim.
  8. For the avoidance of doubt, you do not have an agreement with Parker Kerrigan until you have signed that Agreement and received email confirmation from Parker Kerrigan that attaches your signed Agreement. If you do not receive that Agreement within 24 hours of signing, please contact clients@parkerkerrigan.co.uk.
  9. In respect of fees, Parker Kerrigan will only be paid if you receive a redress payment from your motor finance lender. If you are successful in obtaining a redress payment, you will pay Parker Kerrigan the following, on a per claim basis:
    1. 30% + VAT, up to a maximum of £420, of the amount you receive in relation to a motor finance contract between £1 and £1,499;
    2. 28% + VAT, up to a maximum of £2,500, of the amount you receive in relation to a motor finance contract between £1,500 and £9,999;
    3. 25% + VAT, up to a maximum of £5,000, of the amount you receive in relation to a motor finance contract between £10,000 and £24,999;
    4. 20% + VAT, up to a maximum of £7,500, of the amount you receive in relation to a motor finance contract between £25,000 and £49,999; and
    5. 15% + VAT, up to a maximum of £10,000, of the amount you receive in relation to a motor finance contract above £50,000.
  10. You have the right to cancel this Agreement within 14 days of entering into it, without charge and without giving any reason. The cooling-off period expires 14 days after the day You enter into this Agreement. To cancel within the cooling-off period, you must tell Parker Kerrigan in writing — by email to clients@motorfinance.parkerkerrigan.co.uk or by post to Parker Kerrigan, 80 Strand, London, WC2R 0DT. A cancellation form is included with your Agreement, but you do not have to use it. After the cooling-off period, you may terminate this Agreement at any time by emailing clients@motorfinance.parkerkerrigan.co.uk. Parker Kerrigan does not charge termination fees.
  11. You agree that, by using this website:
    1. It has been made available to you for the purposes of allowing potential clients to evaluate whether they wish to:
      1. make a Claim
      2. notwithstanding that the Financial Conduct Authority has made available a scheme that will be free of charge, use the services of a law firm.
    2. If you do not in good faith believe that you are eligible to make a Claim, then you must not proceed to use the services of Car Claims Checker and/or Parker Kerrigan
    3. By accessing and/or using Car Claims Checker, you agree that:
      1. you were unaware of the charges you incurred on your motor finance agreement because of undisclosed commission / level of commission that was being paid by the finance provider to the Dealer/Broker;
      2. in respect of a possible Claim, you have not instructed a law firm, claims management company (‘CMC’) or made one yourself. If you have done so, by using Car Claims Checker’s services to instruct Parker Kerrigan you agree that you will cancel any other claims with any other law firm or CMC;
      3. you have not received any damages or compensation for this type of Claim, whether in cash or in kind, including receipt of a full refund for any commission payable under a motor finance agreement between 6 April 2007 and 1 November 2024;
      4. you have not filed proceedings in a Court or Tribunal, including with the Financial Ombudsman Service similar to the Claim and lost those proceedings, or those proceedings are ongoing;
      5. you have not settled a diesel emissions claim in respect of the vehicle to which the motor finance agreement relates;
      6. you are domiciled in the United Kingdom;
      7. do not act as a solicitor, work for a firm of solicitors, or a CMC acting (or intending to act) for other claimants or defendants in any claim similar to the Claim; are not a current director, employee, or associate of any employee of a company that was in the business of providing finance for motor vehicles between 2007 and 2024, nor are you a member of a legal team that has been instructed by a motor finance company in the defence of the Claim, and you do not intend to pass on any information about the sign-up process to them or any other person or entity with an interest adverse to the claim; and
      8. do not have any bankruptcy or insolvency proceedings directly impacting you and/or any settlement you may be awarded
  12. If you have a complaint in respect of the services of Car Claims Checker, please submit these to the Complaints Department, SJK Legal Limited, 4-10 Darnley Street, 1st Floor, Glasgow, G41 2SE, or by emailing us at complaints@sjk-solicitors.co.uk. We will send a written acknowledgement of the complaint and a copy of our complaint procedure within three business days of your complaint. If we do not resolve your complaint within 28 days (or such longer time as we may need), or you are not satisfied with our response, you may refer this to the Scottish Legal Complaints Commissioner at https://www.scottishlegalcomplaints.org.uk/your-complaint/.
